1. Acceptance of Terms

By accessing or using Mermaid Studio (the "Service"), available at mermaid.aismarttalk.tech, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Third-party notice: Mermaid Studio uses the open source Mermaid.js library (MIT license) and Mistral AI models hosted in France. This product is not affiliated with or endorsed by the Mermaid.js project or Mermaid Chart.

2. Description of Service

Mermaid Studio is an AI-powered diagram editor built on:

  • Mermaid.js (open source, MIT license) — diagram rendering
  • Mistral AI models hosted in France — AI-assisted generation, via the AI SmartTalk platform
  • AI SmartTalk — authentication, plan management and AI usage metering

The editor, templates, exports and sharing are available free of charge. AI features require an AI SmartTalk account.

3. User Accounts

  • You must authenticate via AI SmartTalk OAuth to use AI features and cloud storage
  • You are responsible for maintaining the security of your credentials
  • You must be at least 16 years old to use the Service

4. Acceptable Use

You agree NOT to:

  • Use the Service for illegal purposes
  • Attempt to bypass rate limits, quotas or security measures
  • Submit harmful, offensive, or infringing content — including in diagrams you publish publicly
  • Reverse engineer or attempt to extract source code (beyond what open source licenses permit)
  • Resell or sublicense the Service without authorization

We may unpublish or remove public content that violates these Terms, and suspend access in case of abuse.

5. Intellectual Property

5.1 Your Content

You retain ownership of diagrams and content you create. By using the Service, you grant us a limited license to process, store and display your content solely to provide the Service — including displaying diagrams you choose to publish on their public pages.

5.2 Our IP

The Service (excluding open source components) is proprietary to AI SmartTalk. Open source components are licensed under their respective licenses (see THIRD-PARTY-LICENSES.md).

5.3 Open Source Components

This product uses Mermaid.js (MIT License, Copyright (c) 2014-2022 Knut Sveidqvist) and other open source libraries. Their licenses are listed in THIRD-PARTY-LICENSES.md.

6. AI-Generated Content

  • AI features run on Mistral models hosted in France — no data is transmitted outside the EU
  • AI-generated diagrams may not always be complete or accurate
  • You are responsible for reviewing and validating generated content before relying on it
  • The AI is classified as limited risk under the EU AI Act — you are always informed when content is AI-generated, and you remain in control of every output

7. Usage Limits and Billing

  • AI generation consumes tokens from your AI SmartTalk plan. Available plans, quotas and prices are defined by AI SmartTalk at aismarttalk.tech; a free tier with monthly tokens is included.
  • Mermaid Studio itself issues no separate invoices; all billing is handled through your AI SmartTalk account.
  • Fair-use technical limits apply (request rate limits, maximum diagram size). We may adjust them to protect Service quality.

8. Publishing and Sharing

  • Publishing a diagram makes it accessible to anyone with the link and indexable by search engines
  • Publishing is always an explicit action; you can unpublish at any time
  • You are solely responsible for the content of diagrams you publish

9. Service Availability

We provide the Service "as is" and do not guarantee 100% uptime. We reserve the right to modify, suspend, or discontinue the Service at any time. Your diagrams remain exportable (Mermaid text, SVG, PNG) at all times.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI SMARTTALK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

11. Governing Law

These Terms are governed by French law. Any dispute that cannot be resolved amicably shall be submitted to the competent French courts, without prejudice to mandatory consumer protection rules of your country of residence within the EU.

12. Changes to Terms

We may update these Terms. Continued use of the Service after changes constitutes acceptance of the new Terms. Material changes will be signaled through the Service interface.
